ABOUT KOOHA

Kooha is a one-of-a-kind photo-sharing mobile application designed to capture beyond moments by collecting your smartphone’s built-in sensor data as you take that wondrous shot, giving your photo richer content!
It responds to a different pain point as compared to other similar applications. Its goal is to create a social network of citizen science, hence the participation of the public especially the Filipino people is highly encouraged to make this endeavor a success.

The photos captured by Kooha are embedded with data such as temperature, sound level, light, motion acceleration, gravity, pressure, among others. When shared to the Kooha Community, your photo becomes more powerful by adding them to the data from other shared photos. Collectively these sensor data can be used for research purposes to improve public services by the transportation and telecommunication companies, business sectors, policymakers, environmental and health sectors, and academe to name a few. The research outputs can help the Filipino people make their next informed decisions.

TERMS OF USE

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to DOST-ASTI.

DOST-ASTI is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The Kooha stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Kooha won’t work properly or at all.

The app does use third-party services that declare their own Terms and Conditions.

You should be aware that there are certain things that DOST-ASTI will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but DOST-ASTI cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, DOST-ASTI cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, DOST-ASTI cannot accept responsibility.

With respect to DOST-ASTI’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. DOST-ASTI accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android – the requirements for the system (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. DOST-ASTI does not promise that it will always update the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.

PRIVACY POLICY

DOST-ASTI built the Kooha application as a free app. This Service is provided by the DOST-ASTI at no cost and is intended for use as is.

This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service.

If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that we collect is used to provide and improve the Service. Kooha is NOT affiliated to whatever Kooha users may share to the app. We will not use or share your information with anyone except as described in this Privacy Policy.

The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at Kooha application unless otherwise defined in this Privacy Policy.

Information Collection and Use

For a better experience, while using our Service, Kooha may collect Personal Information when you choose to interact with Kooha in ways that require Kooha to gather such information, such as if you install or browse on Kooha, register as a Kooha User, update the information on your Kooha profile, provide content to Kooha through your computer or phone, or otherwise communicate with us about the Kooha Services. When you share a Contribution on Kooha, we may collect your display name, email address, gender, year of birth, latitude and longitude of the site of the Contribution, the date and time of the Contribution, the metadata associated with a photo captured, device’s sensor data, network information, and battery information. Kooha collects sensor data and other data for research purposes only. The amount and type of information that Kooha gathers depend on the nature of the interaction. In each case, Kooha collects such information only insofar as is necessary or appropriate to fulfill the purpose of your interaction with Kooha.

Kooha does not disclose Personal Information other than as described below. You can refuse to supply Personal Information, with the caveat that doing so may prevent you from other services and activities, such as registering as a Kooha User, maintaining a Kooha profile, or sharing content to Kooha. Without providing Personal Information (other than the automatic provision of your IP address), you will still be able to access and use Kooha on a read-only basis.

The app does not use third-party services that may collect information used to identify you. The information that we request will be retained by us and used as described in this Privacy Policy.

How We Share and Retain Personal Information

We may use the Personal Information that you provide in order to deliver the Kooha Services and to administer and maintain the Kooha website. If you register as a Kooha User, you must give us current, complete, and accurate information and keep the information you provide to us up to date. We cannot and shall not be responsible for any problems or liability that may arise if you do not give us current, accurate, truthful, or complete information or if you fail to update the information you give us.

We use your information to maintain and improve Kooha. Only the authorized data processor of Kooha has access to your information on how you use the application. The provider of our data centers does not have access to information that will enable your identification.

Kooha discloses Personal Information only to authorized processors and organizations that (i) need to know that information in order to process it on Kooha’s behalf or to provide Services available at Kooha website or application, and (ii) that have agreed not to disclose it to others, except for non-public location data from Contributions for non-commercial research and purposes.

We will keep your information for as long as necessary unless you request the deletion of your information, after which these will be securely deleted. However, we may retain your information when required by law. Kooha will not be responsible if someone saved or shared your data including your personal information or Contributions to other platforms.

Should you wish to have your Personal Information deleted and destroyed or you wish to withdraw your consent in the processing of your personal information or delete/deactivate your account, you may do so by utilizing the Delete Account feature of the Service or by contacting our Data Privacy Officer at privacy@asti.dost.gov.ph.

Log Data

We want to inform you that whenever you use our Service, in the case of an error in the app we collect data and information (through third-party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device’s internal memory.

This Service does not use these “cookies” explicitly. However, the app may use third- party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

Security

We value your trust in providing us with your Personal Information, thus we are striving to use commercially acceptable means of protecting it. We implement reasonable and appropriate physical, technical, and organizational measures to prevent the loss, destruction, misuse, or alteration of your information. While there is no guarantee that information sent over the internet is fully secured, we keep and protect your information using a secured server behind a firewall, encryption, and security controls.

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. Also, for more on this subject, we recommend you to be familiar with the Philippine Republic Act 10173 – Data Privacy Act of 2012.

Children’s Privacy

These Services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do the necessary actions.

Exercising Your Rights

The Data Privacy Act of 2012 gives you certain rights to your information. If you want to exercise your rights or learn more about how Kooha processes your information, please contact our Data Protection Officer at privacy@asti.dost.gov.ph.

COMMUNITY GUIDELINES

OVERVIEW
This Kooha Community Guidelines is designed to ensure safe browsing and sharing experience for Kooha users. This will help us to set the boundaries between what is allowed or not allowed to share in the Community. We aim to build a friendly environment where everyone can freely express themselves without harming or disrespecting other users.
Contributions that are confirmed to have violated any part of the Community Guidelines will be taken down from the Kooha Community.
We encourage everyone to report any questionable contributions that may have inappropriate content such as photos, notes, and tags subject to review and verification by the Kooha Team. To ensure a safe collaboration environment, the Kooha Team will be updating these Community Guidelines whenever necessary.
These are not a replacement for our Terms of Use, and these are not hard and fast rules. These are guidelines and heuristics for how we should conduct ourselves on Kooha. These guidelines do not address our behavior beyond Kooha.
COMMUNITY GUIDELINES
Harassment and Hateful Content
While you are using the app, we want you to feel safe and be able to express yourself through this platform. Generally, harassment is a form of expression intended to insult, threaten, swear, degrade or intimidate a person, group, their religion, identity, ethnicity, disability, or race.
These kinds of behaviors usually provide us with an unpleasant result. It may happen to you and anyone around you. We will not tolerate these behaviors and we will immediately take down any shared contributions that may promote harassment towards others.
Sexual Content or Nudity
We prohibit any form of sexual misconduct including sexual harassment, sexual exploitation, sexual assault, nude images, malicious or explicit content that is sensitive to the Community.
Sexual violence exists everywhere, this is aggressive behaviour that happens or could happen from one person to another. Some users may find these contents sensitive and may cause them trauma. As a part of the community, make sure to share contributions that don’t show any sexual violence.
Integrity and Authenticity
Kooha encourages you to share contributions that were originally taken by you. False or misleading information is intentionally designed to manipulate people’s perceptions of something. This leads to misunderstanding and confusion for all of us. It is commonly spread through social media wherein we spend more of our time interacting with people.
There are a lot of reasons why others share something like this, it could be to create a distraction, gain popularity, protect someone or cover up something, or even to increase their sales. It’s sometimes really hard to identify what’s true from what’s not. So be mindful of the Contributions you share in the Community.
Kooha can be a place where we can build trust in one another, to only share helpful and authentic contributions that others can use to acquire new ideas out of the data that it produces and the contributions you share.
Self-harm or Dangerous Acts
We care about everyone’s safety and we take this seriously. We forbid any shared contributions that promote, encourage, or normalize dangerous acts like suicide, self-harm, eating disorders, risky activities, or insensitive humor about these kinds of behaviour that could lead to serious injury or death.
We also encourage you to contact the nearest help hotlines in your area if you or someone you know needs support or someone you can talk to.
REPORT A CONTRIBUTION
Contributions shared in the Community are meant to produce data that can be used to acquire new knowledge. That’s why we encourage everyone to share their contributions to Kooha mobile app. While you use the app, make sure that each contribution you share does not violate any part of the Community Guidelines.
Take part in keeping the Community safe by reporting any malicious contributions that you may observe while using the app.
To do so,
1. Install the Kooha mobile app from the Google Playstore.
2. Sign in/Sign up to Kooha.
3. On the Community page tap and select Report.
4. Select the appropriate reason for reporting.
5. Tap Report.
Note:
Any submitted report will be subjected to a thorough review by the Kooha Team. Reporters will be notified of the result if they opted to receive an update. The contributor of a contribution with violation shall also be notified given they have an email address available in the Kooha.
kooha@asti.dost.gov.ph. If there are serious problems that you can’t resolve or there are people on the site or application who cannot abide by these guidelines despite numerous requests to change their behavior, please email us and we will assess and possibly suspend these accounts.
